1. Introduction and Scope

These Terms & Conditions (“Terms”) govern your access to and use of the PuneRental.Online website and services (“Platform”), owned and operated by Createxo (“we”, “us”, “Platform”). PuneRental.Online is an online platform that enables Property Owners and Brokers (“Listers”) to list residential rental properties for a standard listing fee. Tenants may search for and view up to 25 property contacts free per calendar year. Use of the Platform constitutes acceptance of these Terms.

2. Definitions

• Listers: Property Owners or Brokers who post property listings on the Platform, for which they pay a standard fee.

• Tenants: Individuals using the Platform to search for rental properties; may receive contact info and optionally share their own contact details.

• Contact Information: Includes phone number, email address, or other personally identifiable information of Tenants or Listers.

3. Eligibility

3.1. You represent and warrant that you are at least 18 years old and legally competent to accept these Terms.
3.2. You are fully responsible for ensuring any property listed is lawfully available and that you have all necessary rights to advertise it.

4. Listing Fees & Payment

4.1. Listers must pay the standard listing fee (as displayed on the Platform) to make their property visible.
4.2. Payment must be made via the methods we support. We reserve the right to suspend or remove listings for non‑payment.
4.3. Listing fees are non‑refundable except where required by applicable law or due to our fault.

5. Free Tenant Access

5.1. Tenants can access contact information of up to 25 properties free of cost per calendar year. Additional contact requests beyond that will incur charges, as notified on the Platform.
5.2. Contact info is made available only so long as listings are active and compliant with Platform rules.

6. Sharing Contact Information

6.1. If a Tenant consents (“opt‑in”), we may share the Tenant’s contact information with Listers associated with properties they inquire about.
6.2. Tenant consent can be withdrawn at any time by email request or via account settings.
6.3. Listers may only use Tenant contact information for legitimate purposes related to a rental inquiry. Use for marketing, spam, resale, or any other unsolicited outreach is strictly prohibited.

7. Acceptable Use and Restrictions

7.1. You agree not to use the Platform to collect, store, or share contact information except for legitimate rental purposes.
7.2. You must not use automated means (bots, screen-scraping, data mining) to access or harvest data from the Platform.
7.3. Any attempt to circumvent listing fees (e.g. arranging transactions off‑Platform after initial contact) may result in continued liability for fees owed.

8. Content and Listing Standards

8.1. Listers are responsible for listing accuracy. Misleading, fraudulent, or illegal listings may be removed without notice.
8.2. You grant us a non‑exclusive, royalty‑free license to use photos, descriptions, or other content you upload for display and marketing of the Platform.

9. Termination & Suspension

9.1. We may suspend or terminate your access to the Platform at any time, with or without notice, for breaches of these Terms.
9.2. Upon termination, we may delete your content and revoke access without liability.

10. Disclaimer & Liability

10.1. The Platform acts as a conduit to connect Listers and Tenants; we are not a party to rental agreements, and do not vet property condition, legality, or suitability.
10.2. We disclaim all liability for any disputes, losses, or damages arising from use of the Platform, to the maximum extent permitted by law.
10.3. Listers and Tenants indemnify and hold us harmless against any claims related to their use of the Platform.

11. Privacy & Data Protection

11.1. Personal data is processed in accordance with our Privacy Policy, which should be read alongside these Terms.
11.2. We comply with applicable data protection laws in India regarding collection, storage, and disclosure of personal data.

12. Intellectual Property

All content on the Platform (design, logos, text) is owned or licensed by us. You may not copy, reuse, or reproduce it without written permission.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra.

14. Changes to the Terms

We may update these Terms at any time. Revised Terms take effect when published on the Platform. Continued use after changes constitutes acceptance.
